These Terms are between Justyna Hurrell trading as FitnessJH ("FitnessJH") and the person accepting them (the "Client"). By signing or electronically accepting these Terms, the Client agrees to be bound by them.

 

Part A – Service, Payment and Cancellation Terms

Eligibility

Feel Strong & Sexy is available only to clients aged 18 or over. By purchasing the service, the Client confirms that they are at least 18 years old.

Contract formation and service commencement

The Client’s signed submission is an offer to enter into the agreement. The agreement becomes binding when FitnessJH confirms acceptance in writing and issues the initial invoice.

A new Client may begin coaching once payment has been received, the required health-screening documents have been completed, FitnessJH has confirmed that the Client is suitable to participate and, where the statutory cancellation period applies, the Client has expressly requested an early start.

If FitnessJH determines before services begin that the Client cannot safely or appropriately be accepted, FitnessJH may decline the service and will refund any payment received in full.

 

Services provided

Feel Strong & Sexy is a rolling monthly coaching service with no fixed minimum term. It includes:

  • One 60-minute personal training session per week;

  • Access to the FitnessJH mobile application;

  • A personalised exercise programme delivered through the application;

  • General healthy-eating information and non-prescriptive meal ideas;

  • Progress recording through the application;

  • Regular check-ins and reasonable programme adjustments; and

  • WhatsApp coaching support as described below.

FitnessJH does not provide medical advice, medical nutrition therapy, prescribed diets or treatment for any medical condition.

Fees and payment

The fee for Feel Strong & Sexy is £260 per calendar month. This is calculated using the weekly price of £60 multiplied by 52 weeks and divided into 12 equal monthly payments.

The monthly fee remains £260 whether a particular calendar month contains four or five scheduled weekly sessions.

FitnessJH will issue invoices using Wix. The initial invoice must be paid before coaching begins. Each subsequent calendar month invoice must be paid in full before the first day of the month to which it relates, using the payment method shown on the invoice. Failure to pay by the due date may result in sessions, application access and coaching support being suspended until payment is received. FitnessJH may terminate the agreement after giving written notice if an invoice remains unpaid. Any amount already due remains payable.

Where the service begins partway through a calendar month, the first invoice will be £60 for each weekly personal training session scheduled between the agreed start date and the end of that month. Access to the application, programme and coaching support will begin on the agreed start date and will not be charged separately during that initial part-month. The regular monthly fee of £260 will apply from the first complete calendar month.

Statutory 14-day cancellation right

Where this agreement is entered into remotely, the Client has the right to cancel it without giving a reason during the statutory cancellation period.

The Client may cancel at any time from the conclusion of the agreement until the end of 14 days after the day on which the agreement is entered into. To exercise this right, the Client must send a clear statement of their decision to cancel to justyna@fitnessjh.com before the cancellation period expires. The Client may use the model cancellation form at the end of these Terms, but is not required to do so.

If the Client has expressly requested that FitnessJH begin providing the service during the cancellation period, the Client must pay £60 for each personal training session provided before cancellation. Any remaining payment will be refunded without undue delay and no later than 14 days after the day on which FitnessJH is informed of the cancellation.

If the Client does not expressly request an early start, the service will begin after the statutory cancellation period has ended.

This statutory cancellation right is separate from the contractual month-end cancellation policy below.

Contractual cancellation after the statutory period.

The Client may cancel Feel Strong & Sexy at any time by giving FitnessJH written notice by email to justyna@fitnessjh.com.

Cancellation will take effect on the final day of a calendar month, provided FitnessJH has received at least 28 days’ notice before that date. If fewer than 28 days remain before the end of the current month, cancellation will take effect on the final day of the following month.

For example, if sufficient notice is received for the service to end on 31 August, August will be the Client’s final month. If fewer than 28 days’ notice is provided before 31 August, the service will end on 30 September.

The normal monthly fee of £260 remains payable for every calendar month up to and including the final month. The Client will continue to receive one personal training session per week and the other Feel Strong & Sexy services until the confirmed end date.

Because cancellation takes effect on the final day of a calendar month, the actual period between the Client giving notice and the service ending may be longer than 28 days.

For cancellations under this policy, monthly fees are charged in complete calendar months and will not be calculated or refunded on a daily basis.

FitnessJH will acknowledge the Client’s cancellation email and confirm the final service date and final payment in writing.

Nothing in this cancellation policy affects the Client’s statutory consumer rights, including any right to an appropriate refund or price reduction where a paid service has not been provided or has not been provided with reasonable care and skill.

 

WhatsApp support

FitnessJH will use reasonable endeavours to respond to WhatsApp coaching messages within one Working Day.

For this purpose, a Working Day means Monday to Friday, excluding UK bank holidays and any holiday or closure period notified to the Client in advance. A message received on a non-Working Day will be treated as received on the next Working Day.

WhatsApp is not continuously monitored and must not be used for medical advice, emergencies or urgent health concerns. Clients requiring medical assistance should contact an appropriate healthcare professional or emergency service.

Rearranging personal training sessions

The Client must give at least 24 hours’ notice if they need to rearrange a personal training session.

Where sufficient notice is given, FitnessJH will offer one replacement session, subject to availability. The replacement should normally be attended within the same calendar month and cannot be exchanged for cash.

Replacement sessions cannot normally be carried forward or accumulated. However, if FitnessJH cannot offer any reasonable replacement time before the end of that month, the replacement may be carried into the following month.

 

If less than 24 hours’ notice is given, or the Client does not attend, the session will be treated as used and will not be refunded or replaced, except at FitnessJH’s discretion.

If FitnessJH cancels a session, FitnessJH will offer a replacement. If a suitable replacement cannot be provided, the Client will receive an appropriate credit or refund.

Session lateness

If the Client arrives late, the session will still finish at its originally scheduled time. If the Client is more than 20 minutes late, FitnessJH may treat the session as missed where there is insufficient time to conduct it safely and effectively. In that situation, the session will not be refunded or replaced, except at FitnessJH’s discretion.

If FitnessJH is late, the session will be extended where reasonably possible or the lost time will be provided on another mutually convenient occasion.

Postnatal clients

FitnessJH does not provide postnatal rehabilitation or treatment for abdominal, pelvic-floor or other postnatal medical conditions.

A postnatal Client will only be accepted where FitnessJH is satisfied that:

  • The proposed training is within the Trainer’s qualifications, professional competence and insurance cover;

  • The Client has completed FitnessJH’s postnatal health screening process;

  • The Client has disclosed relevant complications, symptoms, restrictions and healthcare advice; and

  • The Client is medically suitable to undertake the proposed exercise.

FitnessJH may require written confirmation or guidance from the Client’s GP, midwife, health visitor, physiotherapist or another appropriate healthcare professional before training begins or continues.

Medical clearance does not require FitnessJH to accept the Client and does not replace FitnessJH’s own screening or professional assessment. FitnessJH may postpone training or refer the Client to an appropriately qualified professional where training would fall outside the Trainer’s competence or insurance cover.

 

Privacy and health information

FitnessJH will process personal information in accordance with the FitnessJH Privacy Notice. Health information is particularly sensitive and will be collected only where reasonably necessary to assess exercise suitability, design or adapt the Client’s programme and deliver the service safely.

The Client will be asked to give separate explicit consent to the processing of their health information. The Client may withdraw that consent, although FitnessJH may then be unable to continue providing the service safely.

 

Complaints and contact

Questions, cancellation notices and complaints should be sent to justyna@fitnessjh.com or to the business address shown at the beginning of these Terms. FitnessJH will acknowledge and investigate complaints and respond within a reasonable time.

Governing law

These Terms are governed by the law of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction. Nothing in this clause removes any mandatory rights the Client may have as a consumer in the part of the United Kingdom where they live.

 

Part B – Health Screening, Informed Consent and Acknowledgement of Risk

Health screening and disclosure

Before participating, the Client must complete FitnessJH’s health screening questionnaire fully and accurately.

The Client must inform FitnessJH promptly of anything that could affect their ability to exercise safely, including:

Medical conditions;

  • Pregnancy or recent childbirth;

  • Injuries, pain or physical limitations;

  • Medication that may affect exercise;

  • Medical advice or restrictions; and

  • Any material change in their health.

 

FitnessJH may postpone or suspend training where further information or clearance from an appropriate healthcare professional is reasonably required.

The Client understands that medical clearance does not require FitnessJH to provide training that falls outside the Trainer’s qualifications, professional competence or insurance cover.

Informed consent

The Client understands that the service may include strength training, cardiovascular exercise, mobility work and other physical activities appropriate to the Client’s programme.

The Client understands that physical exercise involves inherent risks which cannot be removed completely, even where reasonable care is taken. These may include muscular discomfort, strains, sprains, falls, aggravation of an existing condition and, in rare circumstances, serious injury or a medical event.

The Client voluntarily agrees to participate with an understanding of these risks. The Client may ask questions, decline an exercise or stop participating at any time.

Client responsibilities

The Client agrees to:

  • Follow the Trainer’s reasonable instructions;

  • Exercise within their own abilities and the agreed programme;

  • Use appropriate clothing, footwear and equipment;

  • Tell the Trainer immediately if an exercise causes unusual pain or discomfort;

  • Stop exercising and seek appropriate assistance if they experience chest pain, faintness, severe dizziness, unusual breathlessness or another concerning symptom;

  • Not participate while affected by alcohol, recreational drugs or anything else that may make exercise unsafe; and

  • Not attempt an exercise they do not understand or feel able to perform safely.

 

The Client should obtain appropriate medical advice if they are uncertain whether exercise is suitable for them.

 

Equipment and training environment

FitnessJH will take reasonable care to maintain equipment supplied within its private studio.

When exercising at home, online, in another gym or without the Trainer physically present, the Client is responsible for choosing a suitable and sufficiently clear exercise area and visually checking any equipment before use.

The Client must not use equipment that appears damaged, unsuitable or unsafe. The Client should contact FitnessJH before attempting an exercise if they are uncertain about the required equipment, technique or environment.

FitnessJH may change or stop an activity if the Trainer reasonably considers it unsafe.

Online and unsupervised exercise

The Client understands that workouts completed through the FitnessJH application or away from a supervised personal training session are not directly supervised.

The Client remains responsible for deciding whether the immediate environment and equipment are safe and whether they feel well enough to exercise that day. The Client must follow the prescribed programme and must not continue through unusual pain or concerning symptoms.

Medical and nutritional limitations

FitnessJH provides personal training and general fitness coaching. FitnessJH does not diagnose or treat medical conditions, provide physiotherapy or replace advice from a doctor or other qualified healthcare professional.

Any healthy eating information or meal ideas are general and educational. FitnessJH does not provide medical nutrition therapy, prescribe treatment diets or act as a registered dietitian or nutritionist.

 

Standard of service and liability

FitnessJH will provide the service with reasonable care and skill.

Nothing in these Terms excludes or restricts FitnessJH’s liability for:

  • Death or personal injury caused by FitnessJH’s negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of the Client’s statutory consumer rights; or

  • Any other liability that cannot legally be excluded or restricted.

 

Subject to those protections, FitnessJH will not be responsible for injury, loss or damage to the extent that it is caused by:

  • The Client providing inaccurate or incomplete health information;

  • The Client failing to disclose a relevant change in their health;

  • The Client disregarding reasonable safety instructions;

  • The Client undertaking exercises outside the agreed programme;

  • Unsafe equipment or premises controlled by the Client or an unrelated third party, where the problem was not caused by FitnessJH and could not reasonably have been identified by FitnessJH; or

  • Events outside FitnessJH’s reasonable control.

 

Nothing in this section removes either party’s responsibility for loss caused by their own actions or failure to take reasonable care.

Results

Individual results vary according to factors including attendance, effort, lifestyle, health and adherence to the programme. FitnessJH does not guarantee any particular weight loss, physical change, performance improvement or timeframe.

Emergencies

FitnessJH may contact the emergency services and the Client’s nominated emergency contact where the Trainer reasonably believes this is necessary to protect the Client’s health or safety.

WhatsApp and the FitnessJH application must not be used to request emergency or urgent medical assistance.

Client confirmation

By signing or electronically accepting this agreement, the Client confirms that:

  • They are aged 18 or over;

  • The information supplied during health screening is complete and accurate;

  • They have read and understood these Terms;

  • They have had the opportunity to ask questions;

  • They understand the nature and inherent risks of physical exercise; and

  • They voluntarily consent to participate.
