Part A - Service, payment and cancellation terms

1. Eligibility and the parties

1.1 Stay Strong is available only to clients aged 18 or over. In these Terms, “FitnessJH” means Justyna Hurrell trading as FitnessJH and “Client” means the individual purchasing the plan.

1.2 The Client confirms that they are acting as a consumer for purposes outside their trade, business, craft or profession.

2. How the agreement is formed and when the service starts

2.1 The Stay Strong webpage and online checkout information invite the Client to purchase the plan. By completing the online checkout, accepting these Terms and submitting payment, the Client places an order for Stay Strong.

2.2 The agreement is formed when the Client receives confirmation that the purchase and first payment have been accepted on FitnessJH’s behalf. The agreement date is the date of that confirmation. The document issue date shown above is not the Client’s agreement date or service start date.

2.3 FitnessJH may require the Client to complete health screening and provide explicit consent to the use of health information before providing a programme or coaching. If FitnessJH reasonably decides that the service cannot be provided safely or within the Trainer’s professional competence or insurance, FitnessJH may cancel the plan and refund any payment for services not provided.

2.4 Because weekly recurring billing begins at checkout, completing the online purchase requires the Client to make the separate, express early-start request described below. That request permits delivery during the statutory 14-day cancellation period but does not remove the right to cancel the continuing service during that period. FitnessJH will begin application access, programme preparation and coaching only after payment, the required health screening and health-information consent have been completed, and FitnessJH has confirmed that the Client is suitable to participate.

3. Services included

3.1 Stay Strong is a rolling online coaching service with no fixed minimum term. It includes:

  • access to the FitnessJH mobile application while the plan remains active;

  • a personalised exercise programme for the Client to complete independently at home or in a gym;

  • healthy-eating education, non-prescriptive meal ideas and general calorie or macronutrient guidance for fitness purposes, where appropriate and within the Trainer’s professional competence;

  • recording of agreed health and fitness progress through the application;

  • weekly online check-ins and reasonable programme adjustments; and

  • WhatsApp coaching support on the basis described in these Terms.

3.2 Stay Strong does not include one-to-one personal training sessions, live video training, direct supervision during exercise or continuous monitoring. Support, programmes and adjustments are personal to the Client and may not be transferred to another person.

3.3 FitnessJH does not provide medical advice, physiotherapy, medical nutrition therapy, prescribed diets, treatment for medical conditions or services that require a registered dietitian or another regulated healthcare professional.

4. Fees and weekly recurring payments

4.1 Stay Strong costs £35 for each seven-day billing period. The first £35 payment is taken at checkout. Unless the plan is cancelled, the Client’s selected payment method will be charged £35 automatically every seven days.

4.2 By completing checkout, the Client authorises the recurring payments shown before purchase. The next payment date will be shown in the Client’s online account or payment confirmation. There is no fixed minimum term and no separate joining fee.

4.3 Each payment covers the next seven-day period of application access and online coaching. Paid weekly periods do not accumulate as credit and are not transferable. Fees are not normally calculated or refunded on a daily basis, except where these Terms or the Client’s statutory consumer rights require a proportionate refund or charge.

4.4 If a recurring payment fails, the payment provider may retry it, apply any configured grace period, suspend access or cancel the plan. FitnessJH may suspend application access, programme updates and coaching while payment remains overdue.

5. Statutory 14-day cancellation right

5.1 Because Stay Strong is purchased online, the Client normally has a statutory right to cancel without giving a reason. The cancellation period ends 14 days after the day on which the agreement is formed.

5.2 The Client may exercise this right by emailing justyna@fitnessjh.com or by sending FitnessJH another clear written statement that they wish to cancel. FitnessJH will then arrange for the recurring payment to be cancelled. The model cancellation form at the end of this document may be used but is not compulsory.

5.3 If the Client cancels during this statutory period and has not requested an early start, FitnessJH will refund all payments received for the cancelled service within 14 days after being informed of the cancellation.

5.4 FitnessJH will begin providing application access, a programme or coaching during the statutory 14-day period only after the Client separately and expressly requests an early start using the required checkbox at checkout. The checkbox must be unticked by default.

5.5 If the Client requests an early start and then cancels during the statutory period, FitnessJH may retain or charge only a proportionate amount for the Stay Strong service supplied up to cancellation. For transparency, this will normally be calculated at £5 for each day on which the service was available, based on the disclosed price of £35 for seven days.

5.6 Any refund will be reduced only by the amount properly payable for services supplied following the Client’s express early-start request. This statutory cancellation right is separate from the ongoing cancellation policy below and does not remove the Client’s statutory rights if the service is faulty or not provided with reasonable care and skill.

6. Ongoing cancellation after the statutory period

6.1 The Client may cancel Stay Strong at any time by giving FitnessJH written notice by email to justyna@fitnessjh.com.

6.2 After receiving the notice, FitnessJH will arrange for the recurring payment to be cancelled at the end of the seven-day billing period already paid for. No further £35 payment will be taken after the effective cancellation date. The Client should email before the next payment becomes due; if FitnessJH receives the cancellation after a renewal payment has been taken, the service will end at the end of that newly paid period.

6.3 Application access and coaching will normally continue until the end of the paid weekly period. A payment already taken is not refunded merely because the Client chooses not to use, or cancels during, that period. This does not apply to cancellation during the statutory 14-day period or where the Client has a statutory right to a refund or price reduction.

6.4 FitnessJH will acknowledge the cancellation email and confirm the final service date in writing.

7. Weekly check-ins and Client participation

7.1 The Client is responsible for completing check-ins and providing reasonably requested information in time for programme review. If the Client does not check in, FitnessJH may continue the existing programme until sufficient information is available to make a safe and appropriate adjustment.

7.2 A missed check-in, an unused workout or a period in which the Client chooses not to contact FitnessJH does not pause the plan, create coaching credit or entitle the Client to a refund. Any discretionary pause or extension must be agreed by FitnessJH in writing.

8. WhatsApp coaching support

8.1 FitnessJH will use reasonable endeavours to respond to WhatsApp coaching messages within one Working Day.

8.2 A Working Day means Monday to Friday, excluding UK bank holidays and any holiday or closure period notified to the Client in advance.

8.3 WhatsApp is not continuously monitored and must not be used for medical advice, emergencies or urgent health concerns. A Client requiring medical assistance must contact an appropriate healthcare professional, NHS 111 or the emergency services as appropriate.

9. Application access and technical availability

9.1 Application access is personal to the Client and must not be shared. The Client is responsible for keeping their login details secure and for using a compatible device and internet connection.

9.2 FitnessJH will use reasonable care to provide access to the application, but short interruptions may occur because of maintenance, updates, internet problems or third-party service failures. FitnessJH will take reasonable steps to restore or provide an appropriate alternative for any material interruption within its control. This does not affect the Client’s statutory rights.

10. Changes to the plan or price

10.1 FitnessJH may make minor changes that do not materially reduce the service, for example to improve delivery, reflect technology changes or comply with law or professional guidance.

10.2 FitnessJH will give at least 28 days’ written notice of any price increase or material reduction in the service, explaining the change and when it will take effect. If the Client does not accept the change, they may cancel by email before it takes effect and the service will end immediately before the change without requiring payment at the increased price. This right applies instead of the ordinary end-of-paid-period cancellation rule for that change.

11. Suspension or termination by FitnessJH

11.1 FitnessJH may suspend programme access or coaching while payment is overdue, while health or safety information is being assessed, or where further medical guidance is reasonably required.

11.2 FitnessJH may end the agreement immediately where there is a serious safety risk, abusive or threatening behaviour, deliberate misuse of the service, or another serious breach that cannot reasonably be corrected. Where a breach can reasonably be corrected, FitnessJH will normally explain the issue and allow a reasonable opportunity to correct it.

11.3 FitnessJH may otherwise end this rolling agreement by giving at least 28 days’ written notice. FitnessJH will stop future recurring payments and refund or credit any proportion of a paid weekly period for which the service will not be provided. This does not affect amounts properly due for services already provided or the Client’s statutory rights.

12. Postnatal clients

12.1 FitnessJH does not provide postnatal rehabilitation or treatment for abdominal, pelvic-floor or other postnatal medical conditions.

12.2 A postnatal Client will be accepted only where FitnessJH is satisfied that:

  • the proposed training is within the Trainer’s qualifications, professional competence and insurance cover;

  • the Client has completed FitnessJH’s postnatal health-screening process;

  • the Client has disclosed relevant complications, symptoms, restrictions and healthcare advice; and

  • the Client is medically suitable to undertake the proposed exercise.

12.3 FitnessJH may require written confirmation or guidance from the Client’s GP, midwife, health visitor, physiotherapist or another appropriate healthcare professional before training begins or continues.

12.4 Medical clearance does not require FitnessJH to accept the Client and does not replace FitnessJH’s own screening or professional assessment. FitnessJH may postpone training or refer the Client to an appropriately qualified professional where training would fall outside the Trainer’s competence or insurance cover.

13. Privacy and health information

13.1 FitnessJH will process the Client’s personal information in accordance with the FitnessJH Privacy Notice at https://www.fitnessjh.com/privacy-notice.

13.2 Health information is special-category personal data. FitnessJH asks the Client to provide separate explicit consent for the collection and use of that information for health screening, suitability assessment, programme design and safe service delivery.

13.3 The Client may withdraw that consent, but FitnessJH may then be unable to continue providing the service safely. Withdrawal does not affect processing that was lawful before consent was withdrawn or information that FitnessJH is legally entitled or required to retain.

14. Complaints and contact

14.1 The Client should raise any concern promptly by emailing justyna@fitnessjh.com. FitnessJH will acknowledge the concern and make reasonable efforts to resolve it fairly.

15. Consumer rights, liability and governing law

15.1 FitnessJH will provide the service with reasonable care and skill. FitnessJH is not automatically responsible merely because a Client suffers an injury, loss or adverse outcome. However, nothing in these Terms excludes or restricts FitnessJH’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, breach of the Client’s statutory consumer rights, or any other liability that cannot legally be excluded or restricted.

15.2 These Terms are governed by the law of England and Wales. The Client retains any mandatory consumer protections and rights concerning where legal proceedings may be brought.

 

Part B - Health screening, informed consent and risk acknowledgement

16. Health screening and ongoing disclosure

16.1 Before participating, the Client must complete FitnessJH’s health-screening questionnaire fully and accurately.

16.2 The Client must inform FitnessJH promptly of anything that could affect their ability to exercise safely, including:

medical conditions;

  • pregnancy or recent childbirth;

  • injuries, pain or physical limitations;

  • medication that may affect exercise;

  • medical advice or restrictions; and

  • any material change in their health.

16.3 FitnessJH may postpone or suspend programme access and coaching where further information or clearance from an appropriate healthcare professional is reasonably required. Medical clearance does not require FitnessJH to provide training that falls outside the Trainer’s qualifications, professional competence or insurance cover.

17. Informed consent

17.1 The Client understands that Stay Strong programmes may include strength training, cardiovascular exercise, mobility work and other physical activities appropriate to the Client’s goals, health information and ability.

17.2 Physical exercise involves inherent risks that cannot be removed completely even where reasonable care is taken. These may include muscular discomfort, strains, sprains, falls, aggravation of an existing condition and, in rare circumstances, serious injury or a medical event.

17.3 The Client voluntarily agrees to participate with an understanding of these risks. The Client may ask questions, decline an exercise or stop participating at any time.

18. Client responsibilities

18.1 The Client agrees to:

  • follow the Trainer’s reasonable instructions;

  • exercise within their own abilities and the agreed programme;

  • use appropriate clothing, footwear and equipment;

  • tell the Trainer immediately if an exercise causes unusual pain or discomfort;

  • stop exercising and seek appropriate assistance if they experience chest pain, faintness, severe dizziness, unusual breathlessness or another concerning symptom;

  • not participate while affected by alcohol, recreational drugs or anything else that may make exercise unsafe; and

  • not attempt an exercise they do not understand or feel able to perform safely.

18.2 The Client should obtain appropriate medical advice if they are uncertain whether exercise is suitable for them.

19. Equipment and training environment

19.1 Because Stay Strong is delivered online, the Client is responsible for choosing a suitable and sufficiently clear exercise area and visually checking all equipment before use, whether exercising at home or in a gym.

19.2 The Client must not use equipment that appears damaged, unsuitable or unsafe. The Client should contact FitnessJH before attempting an exercise if they are uncertain about the required equipment, technique or environment. FitnessJH may change or stop an activity if the Trainer reasonably considers it unsafe.

20. Online and unsupervised exercise

20.1 Stay Strong workouts are completed without the Trainer physically present and are not directly supervised, even where the Client sends messages, photographs, recordings or check-in information.

20.2 The Client remains responsible for deciding whether their immediate environment and equipment are safe and whether they feel well enough to exercise that day. The Client must follow the agreed programme and must not continue through unusual pain or concerning symptoms.

21. Medical and nutritional limitations

21.1 FitnessJH provides general fitness education and online coaching through Stay Strong. FitnessJH does not diagnose or treat medical conditions, provide physiotherapy or replace advice from a doctor or another appropriately qualified healthcare professional.

21.2 Healthy-eating information, meal ideas and any general calorie or macronutrient guidance are educational and provided only within the Trainer’s professional competence and current government healthy-eating guidance. FitnessJH does not provide medical nutrition therapy, prescribe treatment diets or act as a registered dietitian or nutritionist.

21.3 Where the Client has a medical condition, disordered eating, an eating disorder, complex dietary requirements or needs specialist nutrition advice, FitnessJH may decline to provide nutrition guidance and recommend that the Client consult an appropriately qualified GP, registered dietitian or other healthcare professional.

22. Standard of service and responsibility

22.1 FitnessJH will provide the service with reasonable care and skill.

22.2 Subject to the consumer protections stated in Part A, FitnessJH will not be responsible for injury, loss or damage to the extent that it is caused by:

  • the Client providing inaccurate or incomplete health information;

  • the Client failing to disclose a relevant change in their health;

  • the Client disregarding reasonable safety instructions;

  • the Client undertaking exercises outside the agreed programme;

  • unsafe equipment or premises controlled by the Client or an unrelated third party, where the problem was not caused by FitnessJH and could not reasonably have been identified by FitnessJH; or

  • events outside FitnessJH’s reasonable control.

22.3 Nothing in this section removes either party’s responsibility for loss caused by their own actions or failure to take reasonable care.

23. Results

23.1 Individual results vary according to factors including attendance, effort, lifestyle, health and adherence to the programme. FitnessJH does not guarantee any particular weight loss, physical change, performance improvement or timeframe.

24. Emergencies

24.1 FitnessJH may contact the emergency services and the Client’s nominated emergency contact where the Trainer reasonably believes this is necessary to protect the Client’s health or safety.

24.2 WhatsApp and the FitnessJH application must not be used to request emergency or urgent medical assistance.

25. Client confirmation

25.1 By signing or electronically accepting this agreement, the Client confirms that:

  • they are aged 18 or over;

  • the information supplied during health screening is complete and accurate;

  • they have read and understood these Terms;

  • they have had the opportunity to ask questions;

  • they understand the nature and inherent risks of physical exercise; and

  • they voluntarily consent to participate.
