Part A - Service, booking, payment and cancellation terms
1. Eligibility and the parties
1.1 Find Your Strength is available only to clients aged 18 or over. In these Terms, “FitnessJH” means Justyna Hurrell trading as FitnessJH and “Client” means the individual named in the acceptance form.
1.2 The Client confirms that they are acting as a consumer for purposes outside their trade, business, craft or profession.
2. How the agreement is formed
2.1 Information on the Strong Mums Club webpage, including the displayed session price, is an invitation to enquire. It does not itself form a contract or allow the Client to buy a session online.
2.2 Submitting the signed acceptance form is the Client’s offer to enter into this framework agreement. It does not book a session, create a regular arrangement or require the Client to purchase any sessions. The agreement is formed only when FitnessJH confirms acceptance in writing. The agreement date is the date of that confirmation.
2.3 The document issue date shown above is not the agreement date, first session date or start of any recurring arrangement.
2.4 This agreement governs any Find Your Strength sessions that FitnessJH and the Client subsequently confirm under it. A PAYG Client is not required to make another booking. A session becomes confirmed when its date and time have been agreed and FitnessJH has confirmed or recorded the booking in the FitnessJH mobile app, by email, by WhatsApp or through another written method.
2.5 If the Client chooses a regular arrangement, FitnessJH will separately confirm the agreed frequency, regular days or times, session dates and invoicing arrangements in writing. These details may later be updated by written agreement without requiring the Client to sign these Terms again, unless the Terms themselves are materially changed.
2.6 After the agreement is formed, FitnessJH will provide or make available to the Client a copy of the accepted Terms and written confirmation of acceptance in a form that the Client can retain. The agreed sessions and charges will then be recorded through an invoice or other written confirmation as appropriate.
3. What Find Your Strength includes
3.1 Each confirmed booking provides one 45-minute, in-person personal training session in FitnessJH’s private studio. The session may include:

personalised attention and exercise selection during the booked session;
-
instruction and supervision appropriate to the Client’s goals and ability;
-
coaching on exercise technique, form and safe progression; and
-
general healthy-eating education within the Trainer’s professional competence, if relevant to the Client’s fitness goals.
3.2 Unless FitnessJH expressly agrees otherwise in writing, Find Your Strength does not include:
-
access to the FitnessJH mobile application;
-
a personalised workout programme for use outside the booked session;
-
a meal plan, calorie or macronutrient calculation, or prescribed diet;
-
weekly progress check-ins or programme adjustments outside the session; or
-
ongoing WhatsApp coaching or support between sessions.
3.3 FitnessJH does not provide medical advice, physiotherapy, medical nutrition therapy, treatment for medical conditions, or services that require a registered dietitian or another regulated healthcare professional.
4. Booking options and regular arrangements
4.1 The Client may book Find Your Strength in one of the following ways, subject to availability:
a one-off or PAYG session;

a regular arrangement of one session per week;
-
a regular arrangement of two sessions per week; or
-
another frequency agreed in writing.
4.2 A regular arrangement begins only after the Client and FitnessJH have agreed its frequency and FitnessJH has separately confirmed the relevant dates or regular times in writing. It has no fixed minimum term, but the notice rules in clause 9 apply if the Client wishes to reduce the frequency or end the regular arrangement.
4.3 PAYG and one-off clients have no ongoing booking commitment and do not need to give 28 days’ notice merely to stop making future bookings. The cancellation rules for an individual confirmed session still apply.
4.4 Additional sessions may be booked at £45 each, subject to availability. An increase to a regular frequency takes effect only when agreed in writing.
5. Price, invoices and payment
5.1 The price is £45 for each 45-minute session.
5.2 A one-off or PAYG session must be paid in full by the date stated on the invoice and, in all cases, before the session begins unless FitnessJH has expressly agreed otherwise in writing.
5.3 A Client with a regular arrangement may be invoiced monthly in advance. The monthly invoice will be calculated at £45 for each session. For example, one session per week may produce an invoice for four sessions (£180) or five sessions (£225); two sessions per week may produce an invoice for eight sessions (£360), nine sessions (£405) or ten sessions (£450), depending on the confirmed schedule.
5.4 A regular monthly invoice must be paid in full before the first day of the calendar month to which it relates. Where a regular arrangement starts partway through a month, the first invoice must be paid before the first session and will cover only the session dates confirmed for that part-month.
5.5 Fees are charged per confirmed session and are not calculated or refunded on a daily basis. Any credit or refund due under these Terms will be calculated at £45 for each affected session.
5.6 The invoice will state the accepted payment method and payment details. If payment is not received when due, FitnessJH may withhold or suspend the affected sessions and may release a regular time slot. This does not cancel an unpaid invoice for confirmed sessions or remove the need to give notice to end a regular arrangement.
6. When sessions may begin
6.1 A session can begin only after payment has been received, the required health screening information and health data consent have been completed, and FitnessJH has confirmed that the Client is suitable to participate.
6.2 The statutory 14-day cancellation provisions in clause 7 may also prevent FitnessJH from providing a session during the first 14 days unless the Client makes the separate optional early-start request.
7. Statutory 14-day cancellation right
7.1 Where this agreement is entered into at a distance or away from FitnessJH’s business premises, the Client normally has a statutory right to cancel without giving a reason. The cancellation period ends 14 days after the day on which the agreement is formed.
7.2 The Client may exercise that right by emailing justyna@fitnessjh.com or sending another clear statement that they wish to cancel.
7.3 FitnessJH will not provide a session during the statutory 14-day period unless the Client separately and expressly requests an early start using the optional checkbox in the acceptance form.
7.4 If the Client cancels during the statutory period without having requested an early start, FitnessJH will refund payments received for the cancelled service within 14 days after being informed of the cancellation.
7.5 If the Client expressly requests an early start and then cancels during the statutory period, the Client must pay £45 for each session fully provided before cancellation. No charge will be made for sessions not provided. Once a one-off session has been fully performed following the Client’s express request and acknowledgement, the statutory right to cancel that completed session is lost.
7.6 Any refund will be reduced by the amount properly payable for sessions already supplied following the Client’s express early start request. This statutory right is separate from the individual session and recurring arrangement cancellation rules below.
7.7 All later bookings are intended to be supplied under this continuing framework agreement. Nothing in these Terms limits any separate statutory cancellation right that may arise by law in relation to a later booking.
8. Rearranging or cancelling an individual session
8.1 The Client must contact FitnessJH directly by email, WhatsApp, text message or telephone call if they need to rearrange or cancel a confirmed session.
8.2 If the Client gives at least 24 hours’ notice, the same paid session may be rearranged once, subject to availability. For a regular monthly arrangement, the replacement should normally be attended within the same calendar month. For a one-off or PAYG booking, the replacement should normally be attended within 30 days of the original session date.
8.3 Replacement sessions cannot be exchanged for cash, repeatedly rearranged, carried forward indefinitely or accumulated as session credit. If FitnessJH cannot offer any reasonable replacement time within the applicable period, the session may be moved into the following calendar month or an appropriate £45 credit or refund will be provided.
8.4 If the Client gives less than 24 hours’ notice, does not attend, or arrives too late for the session to be delivered safely and effectively, the session may be treated as used and will not be refunded or replaced, except at FitnessJH’s discretion.
8.5 The 24-hour policy does not affect the Client’s statutory cancellation rights or any right to a refund or price reduction where FitnessJH has failed to provide a paid service with reasonable care and skill.
9. Reducing or ending a regular arrangement
9.1 A Client may reduce the frequency of, or end, a regular arrangement at any time by giving FitnessJH at least 28 days’ written notice by email to justyna@fitnessjh.com.
9.2 FitnessJH will acknowledge the notice and confirm in writing the effective change date, the final or revised schedule and any final payment. The effective change date will be no earlier than 28 days after FitnessJH receives the notice. If the Client has already purchased sessions extending beyond that date, the effective change date will normally be the date of the final purchased session, unless FitnessJH agrees otherwise in writing.
9.3 Sessions already confirmed or purchased up to the effective change date remain payable and available for the Client to attend. The Client is expected to use those sessions. They are not cancelled, converted into cash or refunded merely because the Client has chosen to reduce or end the regular arrangement. The individual session rearrangement policy in clause 8 continues to apply, including its limits on carrying forward or accumulating sessions.
9.4 FitnessJH will not schedule or charge for new sessions after the confirmed effective change date. Cancellation under this clause does not create a refund for sessions already confirmed or purchased, except where FitnessJH cannot provide a paid session or a refund, price reduction or other remedy is required by the Client’s statutory consumer rights.
10. Lateness
10.1 If the Client arrives late, the session will normally finish at the original scheduled time and the full £45 fee remains payable.
10.2 If the Client is more than 20 minutes late, FitnessJH may cancel the session and treat it as used where there is not enough time to train safely or effectively.
11. Cancellation by FitnessJH
11.1 If FitnessJH cancels a session, FitnessJH will offer a replacement at a mutually convenient time. If a suitable replacement cannot be provided within a reasonable period, FitnessJH will provide a £45 credit or refund for that session.
11.2 A FitnessJH cancellation will not be counted as a Client cancellation and will not cause the Client to lose the session.
12. Changes to price or terms
12.1 FitnessJH may make minor changes that do not materially reduce the service, for example to improve delivery or comply with law or professional guidance.
12.2 FitnessJH will give at least 28 days’ written notice of any price increase or material change to a regular arrangement. If the Client does not accept the change, they may end the regular arrangement before the change takes effect without paying the increased price. Confirmed sessions before that date remain payable.
12.3 A price or material term change will not apply retrospectively to a one-off or PAYG session that has already been confirmed and paid for.
13. Suspension or termination by FitnessJH
13.1 FitnessJH may postpone or suspend training while payment is overdue, while health or safety information is being assessed, or where further medical guidance is reasonably required.
13.2 FitnessJH may end this agreement immediately where there is a serious safety risk, abusive or threatening behaviour, deliberate misuse of the service, or another serious breach that cannot reasonably be corrected. Where a breach can reasonably be corrected, FitnessJH will normally explain the issue and allow a reasonable opportunity to correct it.
13.3 FitnessJH may otherwise end a regular arrangement by giving at least 28 days’ written notice. Any payment for sessions that will not be provided will be refunded or credited at £45 per session. This does not affect amounts properly due for sessions already supplied or confirmed within the notice period.
14. Postnatal clients
14.1 FitnessJH does not provide postnatal rehabilitation or treatment for abdominal, pelvic-floor or other postnatal medical conditions.
14.2 A postnatal Client will be accepted only where FitnessJH is satisfied that:
-
the proposed training is within the Trainer’s qualifications, professional competence and insurance cover;
-
the Client has completed FitnessJH’s postnatal health-screening process;
-
the Client has disclosed relevant complications, symptoms, restrictions and healthcare advice; and
-
the Client is medically suitable to undertake the proposed exercise.
14.3 FitnessJH may require written confirmation or guidance from the Client’s GP, midwife, health visitor, physiotherapist or another appropriate healthcare professional before training begins or continues.
14.4 Medical clearance does not require FitnessJH to accept the Client and does not replace FitnessJH’s screening or professional assessment. FitnessJH may postpone training or refer the Client to an appropriately qualified professional where the proposed training would fall outside the Trainer’s competence or insurance cover.
15. Privacy and health information
15.1 FitnessJH will process the Client’s personal information in accordance with the FitnessJH Privacy Notice at https://www.fitnessjh.com/privacy-notice.
15.2 Health information is special category personal data. FitnessJH asks the Client to provide separate explicit consent for the collection and use of that information for health screening, suitability assessment, session design and safe service delivery.
15.3 The Client may withdraw that consent, but FitnessJH may then be unable to continue providing the service safely. Withdrawal does not affect processing that was lawful before consent was withdrawn or information that FitnessJH is legally entitled or required to retain.
16. Complaints and contact
16.1 The Client should raise any concern promptly by emailing justyna@fitnessjh.com. FitnessJH will acknowledge the concern and make reasonable efforts to resolve it fairly.
17. Consumer rights, liability and governing law
17.1 FitnessJH will provide the service with reasonable care and skill. FitnessJH is not automatically responsible merely because a Client suffers an injury, loss or adverse outcome. However, nothing in these Terms excludes or restricts FitnessJH’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, breach of the Client’s statutory consumer rights, or any other liability that cannot legally be excluded or restricted.
17.2 These Terms are governed by the law of England and Wales. The Client retains any mandatory consumer protections and rights concerning where legal proceedings may be brought.
Part B - Health screening, informed consent and risk acknowledgement
18. Health screening and ongoing disclosure
18.1 Before participating, the Client must complete FitnessJH’s health-screening questionnaire fully and accurately.
18.2 The Client must inform FitnessJH promptly of anything that could affect their ability to exercise safely, including:
medical conditions;
-
pregnancy or recent childbirth;
-
injuries, pain or physical limitations;
-
medication that may affect exercise;
-
medical advice or restrictions; and
-
any material change in their health.
18.3 FitnessJH may postpone or suspend training where further information or clearance from an appropriate healthcare professional is reasonably required. Medical clearance does not require FitnessJH to provide training outside the Trainer’s qualifications, professional competence or insurance cover.
19. Informed consent
19.1 Find Your Strength sessions may include strength training, cardiovascular exercise, mobility work and other physical activities appropriate to the Client’s goals, health information and ability.
19.2 Physical exercise involves inherent risks that cannot be removed completely even where reasonable care is taken. These may include muscular discomfort, strains, sprains, falls, aggravation of an existing condition and, in rare circumstances, serious injury or a medical event.
19.3 The Client voluntarily agrees to participate with an understanding of these risks. The Client may ask questions, decline an exercise or stop participating at any time.
20. Client responsibilities
20.1 The Client agrees to:
-
follow the Trainer’s reasonable instructions;
-
exercise within their own abilities and the agreed session;
-
wear appropriate clothing and footwear;
-
tell the Trainer immediately if an exercise causes unusual pain or discomfort;
-
stop exercising and seek appropriate assistance if they experience chest pain, faintness, severe dizziness, unusual breathlessness or another concerning symptom;
-
not participate while affected by alcohol, recreational drugs or anything else that may make exercise unsafe; and
-
not attempt an exercise they do not understand or feel able to perform safely.
20.2 The Client should obtain appropriate medical advice if they are uncertain whether exercise is suitable for them.
21. Equipment and studio environment
21.1 FitnessJH will take reasonable care to maintain the equipment and training area supplied within its private studio.
21.2 The Client must follow reasonable instructions about equipment use and tell FitnessJH promptly if equipment appears damaged, unsuitable or unsafe. FitnessJH may change or stop an activity if the Trainer reasonably considers it unsafe.
22. Medical and nutritional limitations
22.1 FitnessJH provides personal training and general fitness education. FitnessJH does not diagnose or treat medical conditions, provide physiotherapy or replace advice from a doctor or another appropriately qualified healthcare professional.
22.2 Any healthy eating information is general education provided only within the Trainer’s professional competence and current government healthy eating guidance. FitnessJH does not provide medical nutrition therapy, prescribe treatment diets or act as a registered dietitian or nutritionist.
22.3 Where the Client has a medical condition, disordered eating, an eating disorder, complex dietary requirements or needs specialist nutrition advice, FitnessJH may decline to provide nutrition guidance and recommend that the Client consult an appropriately qualified GP, registered dietitian or other healthcare professional.
23. Standard of service and responsibility
23.1 FitnessJH will provide the service with reasonable care and skill.
23.2 Subject to the consumer protections stated in Part A, FitnessJH will not be responsible for injury, loss or damage to the extent that it is caused by:
-
the Client providing inaccurate or incomplete health information;
-
the Client failing to disclose a relevant change in their health;
-
the Client disregarding reasonable safety instructions;
-
the Client undertaking exercises outside FitnessJH’s instruction;
-
unsafe equipment or premises controlled by the Client or an unrelated third party, where the problem was not caused by FitnessJH and could not reasonably have been identified by FitnessJH; or
-
events outside FitnessJH’s reasonable control.
23.3 Nothing in this section removes either party’s responsibility for loss caused by their own actions or failure to take reasonable care.
24. Results
24.1 Individual results vary according to factors including attendance, effort, lifestyle, health and activity outside the sessions. FitnessJH does not guarantee any particular weight loss, physical change, performance improvement or timeframe.
25. Emergencies
25.1 FitnessJH may contact the emergency services and the Client’s nominated emergency contact where the Trainer reasonably believes this is necessary to protect the Client’s health or safety.
25.2 Email, text message and WhatsApp must not be used to request emergency or urgent medical assistance.
26. Client confirmation
26.1 By signing or electronically accepting this agreement, the Client confirms that:

they are aged 18 or over;
-
the information supplied during health screening is complete and accurate;
-
they have read and understood these Terms;
-
they have had the opportunity to ask questions;
-
they understand the nature and inherent risks of physical exercise; and
-
they voluntarily consent to participate.
